Terms of Service

2. Eligibility

You must be at least 16 years old to create an account or use the Service. Stealthy collects health information, including menstrual cycle data for users who enable that feature, and this minimum age reflects the sensitivity of that data. We do not knowingly collect personal information from anyone under this age. If we become aware that we have done so, we will delete that account and the associated data.

3. What the Service actually does

Stealthy is a companion app for two pieces of Stealthy hardware, the Watch Clasp and the Sports Band, connected to your phone over Bluetooth. Depending on which Device you pair and wear, the Service may display, store, and analyse:

• Real-time and historical heart rate, heart rate variability (HRV), blood oxygen (SpO2), step count, and sleep stage data reported by your Device
• Derived metrics computed from that raw data, including a Focus Index, Body Battery, stress estimate, and a Biological Age estimate
• Workout sessions you record, including duration, GPS route (where location access is enabled and the workout type uses it), heart rate during the session, and, for strength training, sets, reps, and weight you log manually
• Menstrual cycle information you choose to log, if you enable that feature
• A daily natural-language summary (t("Signal")) generated from your own recent data
• Calendar events, either imported locally or fetched by connecting a Google or Microsoft calendar, to correlate with your stress patterns. This data is never transmitted to or stored on Stealthy's servers (see the Privacy Policy, section on Calendar Data, for the full explanation of this)

4. Health and wellness disclaimer: please read this section carefully

The Service is a general wellness and fitness product. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

• Biological Age, calorie estimates, stress scores, readiness indicators, and every other derived metric in the Service are statistical estimates based on formulas applied to your own data. They are not clinical measurements and may differ from a measurement taken by a medical professional or a certified medical device.
• Heart rate, HRV, SpO2, and sleep data are captured by consumer-grade sensors in the Devices, which have accuracy limitations inherent to that category of hardware. Skin contact, movement, ambient conditions, and individual physiology can all affect accuracy.
• The menstrual cycle feature is based on dates and symptoms you log yourself, combined with correlation against your heart rate and HRV data. It is not a substitute for a medical method of cycle tracking or contraception, and Stealthy explicitly disclaims any reliance on it for contraceptive purposes.
• Do not use the Service as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions about a medical condition, and before making changes to exercise, diet, or medication based on anything shown in the Service.
• If you experience a medical emergency, contact emergency services immediately. Do not rely on the Service.

5. Your account

You may create an account using an email address and password, or by signing in with a Google or Apple account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately atinfo@wearstealthy.comif you suspect unauthorised access to your account.

You are responsible for providing accurate profile information (birth year and month, biological sex, height, weight) where you choose to provide it. This information is used only to improve the accuracy of the calculations described in section 3: heart rate zone thresholds, Biological Age, and calorie estimates specifically depend on it, and the Service will fall back to less accurate defaults for any field you leave blank.

6. Devices

• The Watch Clasp and Sports Band are Bluetooth Low Energy hardware. You are responsible for the physical care, charging, and reasonable use of any Device you own.
• The Devices have no screen and no vibration motor. All alerts, notifications, and data are delivered through the Stealthy app on your phone, not on the Device itself.
• Some features (continuous background sync, certain notification types) depend on Bluetooth remaining connected and the app having appropriate permissions on your phone. Feature availability may vary by phone operating system and version.
• Stealthy does not warrant that the Devices will be free of defects. Hardware warranty terms, if any, will be provided separately at the point of purchase.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or extract source code from the app or Device firmware, except to the extent this is permitted by law and cannot be excluded by agreement
• Interfere with or disrupt the Service, including attempting to gain unauthorised access to other users' accounts or data
• Use automated means to scrape, extract, or bulk-download data from the Service
• Misrepresent your identity or impersonate another person when creating an account

8. Intellectual property

The Service, including its software, design, trademarks, and content (but excluding your own personal data), is owned by Stealthy or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose on a compatible device that you own or control. All rights not expressly granted are reserved.

9. Third-party services

The Service relies on the following third-party providers to function. Each processes a real, specific subset of your data as described in the Privacy Policy:

• Supabase: hosts our database, authentication, and file storage
• Google: Sign in with Google; Google Maps for displaying workout routes; and, if you choose to connect a Google Calendar, read-only access to its events to correlate with your stress data, processed directly between your device and Google and never through our servers
• Microsoft: if you choose to connect a Microsoft or Outlook calendar, read-only access to its events for the same purpose, processed directly between your device and Microsoft and never through our servers
• Apple: Sign in with Apple
• OpenAI: generates the natural-language text of your daily Signal briefing from a real summary of your own data
• Apple Push Notification service (APNs) and Firebase Cloud Messaging (FCM): deliver push notifications to your device

Your use of the Service is also subject to the applicable terms of these providers. We are not responsible for the availability or performance of third-party services outside our control.

10. Subscriptions and fees

The Service does not currently have a subscription or in-app purchase model implemented. For the current, up-to-date position on pricing and any paid features, please refer to//stealthy.band/.

11. Termination

You may stop using the Service at any time. To delete your account and associated data, contact us using the details in section 15; we aim to complete deletion within 30 days of a verified request. We may suspend or terminate your access to the Service if you breach these Terms, or if we reasonably believe your account has been used fraudulently or to harm the Service or other users. On termination, your right to use the Service ends immediately; your data will be handled as described in the Privacy Policy's data retention and deletion sections.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Stealthy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the Service or the cost of having the Service resupplied.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising from these Terms or the Service.
